MONTHLY DUES: $29.95 (+tax)
AUTOMATIC RENEWAL: Your Membership Agreement will automatically continue on a month-to-month basis until a 30-day advance written notice is given by either party.
ENROLLMENT: A one-time enrollment fee of $50 will be applied.
KEY CARD: First card included with membership. For lost, stolen, or misplaced keycards, a replacment card can be purchased for $30.
CANCELLATION: Member may cancel this Membership Agreement at any time by signing a cancellation notice thirty(30) business days prior to the monthly dues date. (“Cancellation Notice”). Member must be in good standing with no outstanding balance in order to process the cancellation request. Absolutely no telephone cancellations, email requests, or social media requests will be accepted as forms of cancellation notice.
AGREEMENT FOR PAYMENT AND PROCESSING: I understand that by signing this Membership Agreement, I agree to the following terms: My Membership Agreement shall be processed & collected by LEGACY FITNESS and that any future involvement I may have regarding the billing of this Membership Agreement will be directly with LEGACY FITNESS in writing at the address above or such address that is provided to me in writing. My failure to regularly attend and utilize LEGACY FITNESS’S facilities does not relieve me of my obligation, regardless of the circumstances, to pay all agreed monthly payments. I understand that, except as herein provided, my Membership Agreement is non-cancellable. Should I default, I agree to pay all costs of collection, including but not limited to, Collection Agency fees, court costs, and reasonable attorney’s fees, all of which may be paid or incurred by the Primary Member under this Membership Agreement. As a convenience to me, I authorize my Bank to honor pre-authorized drafts by LEGACY FITNESS for membership payments and/or contributions. When the bank or credit carrier honors the draft by charging my account, such drafts constitute my receipt for payment. I understand that I am in full control of my account and I may change my ACH/EFT authorization by written notification to LEGACY FITNESS; It is to be submitted in writing at least 10 days prior to the bank draft date (using approved forms). Terminations will not be accepted until all balances or past dues are paid in full. I understand that cancellation of ACH/EFT authorization in no way relieves me of my obligation to fulfill any and all obligations under this Membership Agreement.
NSF/DECLINES/LATE FEES: All drafts returned “non-sufficient funds’ (NSF) will be drafted as soon as funds are available. If the second draft attempt is returned as “NSF,” the membership will be terminated. For each return, LEGACY FITNESS will collect a separate $15 fee to cover bank and administrative costs. All membership and/or program balances must be paid prior to membership termination being accepted. If any installation is more than ten days past due, a late charge of $15 will be implemented..
DISCLAIMER OF LIABILITY; WAIVER OF LIABILITY; ASSUMPTION OF RISK: Member acknowledges that the use of LEGACY FITNESS’s facilities, equipment, services and programs involves an inherent risk of personal injury to Member and Member’s guests and invitees. Member voluntarily agrees to assume all risks of personal injury to Member, Member’s spouse, children, unborn children, other family members, guests or invitees and waives any and all claims or actions that Member may have against LEGACY FITNESS, any of its subsidiaries or other affiliates and any of their respective officers, directors, employees, agents, successors and assigns for any such personal injury (and no such person shall be liable to Member, Member’s spouse, children, unborn children, other family members, guests or invitees for any such personal injury), including, without limitation (i) injuries arising from use of any exercise equipment, machines and tanning booths, (ii) injuries arising from participation in supervised or unsupervised activities and programs in exercise rooms, running tracts, swimming pools, hot tubs, courts or other areas of any LEGACY FITNESS, (iii) injuries or medical disorders resulting from exercising at LEGACY FITNESS, including heart attacks, strokes, heat stress, sprains, broken bones and torn or damaged muscles, ligaments or tendons and (iv) accidental injuries occurring within LEGACY FITNESS facilities, including locker rooms, steam room, whirlpools, hot tubs, spas, saunas, showers and dressing rooms. Member acknowledges that (i) LEGACY FITNESS does not manufacture any of the fitness or other equipment at its facilities and (ii) LEGACY FITNESS does not manufacture any vitamins, food products, sports drinks, nutritional supplements or other products sold at its facilities; accordingly, neither LEGACY FITNESS, any of its subsidiaries or other affiliates nor any of their respective officers, directors, employees, agents, successors or assigns shall be held liable for any such defective equipment or products. Member shall indemnify LEGACY FITNESS, its subsidiaries and other affiliates and each of their respective officers, directors, employees, agents, successors and assigns (the “Indemnified Party”) and save and hold each of them harmless against and pay on behalf of or reimburse any such Indemnified Party as and when incurred for any losses which such Indemnified Party may suffer, sustain or become subject to, as a result of, in connection with, relating or incidental to or by virtue of any claim that is the subject of the waiver set forth above. The provisions of this Section shall survive the termination of this Membership Agreement and Member’s membership
RULES AND REGULATIONS. MEMBER AGREES TO FOLLOW LEGACY FITNESS’S RULES AS PROMULGATED FROM TIME TO TIME: Member acknowledges the existence of and the need for rules and regulations governing use of LEGACY FITNESS’s equipment and facilities and participation in programs and services (the “Rules and Regulations”). Member agrees to comply with the Rules and Regulations as presently in effect or as they may hereafter be modified, amended or supplemented. LEGACY FITNESS reserves the right to modify, amend or supplement the Rules and Regulations from time to time, in its sole discretion. LEGACY FITNESS may cancel Member’s membership at any time for breach of the Rules and Regulations or generally undesirable behavior, as determined by LEGACY FITNESS in its sole discretion, and Member will not be entitled to a refund of any portion of initiation fees or dues paid to the date of cancellation. Members who misuse and/or break any property of LEGACY FITNESS knowingly, unknowingly, willfully and/or non-willfully can and will be responsible for charges for the cost of new item, including any shipping and installation charges.
